Reversed - Hearing Officer reversed the Department’s finding of neglect where the appellant-mother held the infant child during a brief verbal and physical altercation with the child’s paternal grandfather-legal guardian. The child appeared unharmed by the incident, and the Hearing Officer determined it had not affected the child’s emotional stability or growth, nor was there substantial risk or harm to the child. Appellant showed on a preponderance of evidence that the Department’s decision was not made in conformity with regulations or on a reasonable basis. Reversed for substantive error.
