Reversed - The Hearing Officer found that there was insufficient evidence to affirm the supported 51B decision for physical abuse; the decision was reversed. The alleged physical abuse was the result of physical discipline in which the appellant hit his son on his buttocks with a belt, over his clothes. The appellant also talked with his son before and after the physical punishment; the child was clear that the discipline did not hurt him, but did not tickle. The child reported that his parents do not hurt or abuse him, and that he was happy and safe with his parents.
