Reversed - DCF did not have sufficient evidence to support a finding of neglect by Appellant father when 1) the decision to support was made largely relying on statements from Appellant's ex-wife (and child's mother) and her therapist; 2) there is an ongoing case in Family and Probate Court, which is in a better position to deal with the issue; and 3) DCF found that Appellant failed to allow the child to engage in services or take medication for her recent ADHD diagnosis even though she was in therapy at the time of the report and the child is taking medicine pursuant to a later stipulation. The evidence warranted concern by DCF, but the overall evidence was insufficient to support a finding of neglect.
