In May 2021, MassHealth amended its Medicaid estate recovery regulations to create additional grounds for waiving estate recovery on the basis of undue hardship to the heirs. MassHealth also developed a new notice about estate recovery that was mailed to over 500,000 MassHealth members age 55 or older and nursing home residents. For many MassHealth members the existence of estate recovery was brand new information giving rise to many questions about what estate recovery is and what they should do about it.

The purpose of this webinar is to provide assisters and legal aid advocates with the resources to respond to some of the more common questions they are likely to get from members including sources of basic information about the probate process and the MassHealth estate recovery rules, finding out what you own and how you own it, how to find out how much MassHealth has paid out on your behalf to date, and referral resources for MassHealth members who need to consult with a lawyer or other professional for advice about their individual situation.
