The appellant is a 22 year old male who has been diagnosed with Asperger's syndrome and suffers from significant anxiety, for which he takes medication. He lives in his own apartment and works twenty hours per week at a Stop and Shop.

Dr. Richard Costigan, the Department's Regional Psychologist, testified that the appellant is not eligible for DMR services because his IQ scores did not meet the DMR standard. Appellant's full scale scores were between 103 and 75.


The hearing officer agreed with Dr. Costigan. She concluded that the appellant is disqualified from receiving DMR services because he consistently received full scale IQ scores above 75.
