In this Central Housing Court case, the court found that the landlord failed to prove by a preponderance of the evidence that the tenant violated their lease by allowing their son to start a fire or by permitting a third-party trespass.

Regarding the alleged trespass, the court held that the landlord did not have the unilateral right to impose a no-trespass order against a third party and had not followed the proper procedure to ban someone from the property.

The tenant was represented by Michelin Cahill and Annie Guare of CLA.
