The HO decided that Belmont's behavior intervention plan (BIP) was overly restrictive, and he denied the town's request to force its implementation. Decision involved a 10 year old, 5th grade boy who had ODD and difficulty controlling some aggressive and risky behaviors.  The BIP included use of an "opportunity room" where student was confined if he demonstrated poor behaviors and he remained there until he could demonstrate appropriate behaviors.  The BIP was developed outside of the IEP Team process. The HO found that Belmont's BIP was overly restrictive and would have a negative effect on the student.
