Here are two cases in which erroneous decisions (one by DUA in which the BOR denied review (Waters), and one in which the Board denied benefits, reversing a correct DUA decision (Regalado) were reversed by agreement of the parties in District Court.
Memoranda of law in both cases are attached below, as is the BOR decision in the Regalado case. The Waters case concerned a medical leave of absence and the Regalado case concerned the adequacy of a former employee's efforts to inform her former employer that she intended to return to work for the next school year after the summer vacation period.
Advocates with adverse final decisions that they believe are erroneous might want to review these cases, which DUA agreed to settle after complaints for judicial review were filed.
