Claimant who was discharged after failing drug test found that employer did not meet burden of proving deliberate misconduct. No evidence that drug testing was conducted in accordance with accepted standards. Also policy prohibited being under influence in workplace and employer did not meet burden that claimant was under the influence based on positive test for marijuana.
