In the Matter of JE, FH# 2017-1368
Date:
Affirmed - DCF had a reasonable basis for closing Appellant's case and terminating services where Appellant was not compliant with his service plan tasks, whereas there was substantial evidence showing that the biological mother of the Appellant's child was abiding by her service plan, engaged in treatment for her addiction, remained sober, provided adequately for the needs of the child, and demonstrated good judgement to keep the child safe. The Appellant initially came to the Department's attention after his child and the mother tested positive for illicit substance at the time of the child's birth in 2015. The Appellant and his child's mother eventually separated, and, as stated above, while the Appellant did not comply with the tasks assigned to him, the mother did and was shown to be adequately meeting the needs of the child.
