KCS Blog: U.S. DOE Upholds Students’ Rights to Special Education During Coronavirus Crisis

KCS commentary on the US DOE guidance of March 21, 2020. The March guidance clarifies that districts must provide FAPE and may not issue blanket refusals to provide educational services in order to avoid the challenges of providing special education services during the crisis.
The guidance also clarifies that timelines remain in effect although parents and schools may decide on “mutually agreeable extensions of time, as appropriate.” The guidance also encourages schools to hold IEP meetings remotely. IEP's may also be amended without meeting if parents and the school agree.
