Assessment of students w/ significant cognitive disabilities under NCLB -- new regulations

Yesterday the U.S. Department of Education issued in the Federal Register of December 9, 2003, final regulations under Title I of the No Child Left Behind Act that specifically authorize states to assess students with the most significant cognitive disabilities (as defined by each state) using alternate achievement standards that are, among other things, aligned to the state's own content standards. If a state chooses to evaluate this specific population of students using an alternate assesssment based on alternate achievement standards, the State may count for purposes of AYP those students who score proficient or above on the alternate achievement standards, provided that the number of proficient or advanced scores does not exceed 1% of all students in the grades tested at the State or LEA level.

The Department had proposed amending the Title I of NCLB regulations to allow States to develop and use alternate achievement standards for students with the most significant cognitive disabilities for purposes of determining AYP in an NPRM, March 20, 2003.
