SSA Request for Waiver of Overpayment and Request for Reconsideration Forms

SSDI and/or SSI beneficiaries who received a formal notice from SSA stating that they were overpaid may use SSA Waiver of Overpayment form to request a waiver of an overpayment or a change in the rate at which SSA recoups the overpayment. By requesting a waiver, you may be admitting that there is an overpayment but are claiming that you should not have to pay it back. However, SSA still must provide evidence that will show the fact and the amount of an overpayment in every case.   Access the Waiver form from SSA's website at this link, www.ssa.gov/online/ssa-632.html

SSDI and/or SSI recipient who did not receive an adequate explanation from SSA about how/when their overpayment happened or who disagree with SSA determination regarding the overpayment may appeal the overpayment determination by submitting the Request for Reconsideration form. Access the reconsideration form from SSA's website at this link,  www.ssa.gov/online/ssa-561.html

There is no deadline for requesting a waiver, but there is a 60 days (plus 5 days for mailing) deadline for filing a Request for Reconsideration.
