Section 504 and ADA

Section 504 and ADA are federal anti-discrimination laws.  504 and ADA cover all students covered under IDEA as well as other students with disabilities who are not eligible for IDEA.

Hornstine v. Township of Moorestown

A federal court in New Jersey issued an injunction prohibiting a school district from implementing a policy allowing for multiple valedictorians at high school graduation. The policy had been proposed following complaints that the likely valedictorian, a student with a disability who had the highest weighted grade point average in her class, had had an unfair advantage due to the disability-related accommodations she had received. The student prevailed on her claim that applying this policy would discriminate against her on the basis of disability, in violation of the ADA and Section 504 of the Rehabilitation Act.
