Transition

There are two laws that provide transition requirements for youth with disabilities in Massachusetts. The first is the requirement under the Individuals with Disabilities Education Act and Mass regulations for a school district to provide a disabled student with transition services between the ages of 14-22.  The second is Chapter 688, a Massachusetts law that establishes a planning process for a severely disabled student, including referral to the agency most likely to serve the student after they graduate or turn 22.   See under EOHHS category for more information on 688 and agencies to which a student may transition, http://www.masslegalservices.org/cat/3395

Student with Downs Syndrome did not receive an adequate IEP, and the school did not communicate adequately with parents. The District was ordered to reimburse parents for tuition at a prvate school. The hearing officer placed great weight on the testimony of Dr A. Roffman who observed the student and who provides details on what a transition plan should include.

The purpose of this advisory is to highlight a recent law passed by the Massachusetts Legislature. On August 6, 2008, the Massachusetts Legislature approved Chapter 285 of the Acts of 2008, which amends Section 2 of c.71B (the Massachusetts special education statute) by adding that transition planning must begin when a student is 14 or sooner.
