This Field Ops memo instructs workers on a range of "negative errors" including erroneous denials and potential underpayments, using examples where workers should not have asked for verification already in a file or erroneously calculated benefits.  There are very important examples in this memo for advocacy work.

Food Stamps and Utility Expenses: Advocacy letters and CLE flier

Attached are two updated documents and a Client Legal Education flier
on FS and Utility Expenses. MLRI has received reports of Food Stamp recipients being underpaid because DTA did not consider their heating/cooling expenses or receipt of fuel assistance when calculating their food stamp amount.  In order to get the case updated prospectively and request a restoration of lost benefits, advocates and/or FS recipients should write a letter to the Assistant Director of the DTA office.  The attached documents can serve as templates for advocates and pro-se Food Stamp recipients when they are requesting a restoration of lost benefits.  The files are labelled accordingly (for advocate or FS recipient).

PDF Document FYI: Economic Stimulus Rebate can be intercepted for Food Stamp overpayments

AU Managers are reminded that the federal government regularly intercepts certain federal payments made to clients and former clients - such as income tax refunds - to offset outstanding client food stamp debts.  The federal Economic Stimulus payment described in Field Operations Memo 2008-18 is also subject to intercept for these debts.  If a client calls inquiring about a reduction or loss of an Economic Stimulus payment,  refer the client to the Fraud Investigations and Recoveries Unit at 1-800-462-2607 for information regarding the intercept.

Overpayment can not be recouped from child-- FNS response to complaint

Marion Hohn and Katie Blake of WMLS secured a directive from the federal Food and Nutrition Service of the U.S. Dep't of Agriculture barring DTA from recovering a food stamp overpayment by reducing the allotment for the client's grandson.  Attached is a client complaint that Marion submitted to the federal Food and Nutrition Service and the favorable response.
