The court in this case found EA termination notices insufficient. DTA sent all families terminated between 12/05 and 11/06 notice of the right to reapply. The email provides instructions for caseworkers on how to process reapplications, including that 12 month rule does not apply and that a more complete termination notice for original termination must be provided and is appealable.

EA notices have been updated to include local case worker phone number. This FOM also directs local offices to provide EA families with all of the documentation regarding the reason for adverse action if the family requests such information, and lists the documents that must be provided.

In June 2007, the Commissioner sent a letter to all shelter providers and TAO Directors informing them that the Department was planning to review current EA regulations and procedures as they relate to homeless sheltered families, specifically around the noncompliance process. On October 9, 2007 a letter of clarification relative to the noncompliance process was issued to all shelter and HAP providers. This memo discusses the same issues contained in the October letter. THIS FOM IS OBSOLETE AND REPLACED BY FIELD OP MEMO 2008-62.

Field Op Memo 2008-10: EA: Revisions to NFL-9 and NFL-ST and the Introduction of the NFL-ST/CA

Currently when an EA family is terminated from a temporary emergency shelter, the AU Manager or Homeless Coordinator completes either the NFL-9 or the NFL-ST notice online.  These notices have been revised to allow the  AU Manager or Homeless Coordinator additional space to annotate detailed information (“who, what, where and when”) relating to the appropriate termination reason selected.  Refer to Field Operations Memo 2007-61 for further details.  In addition, a new notice has been created for terminations due to criminal activity.
