Beginning November 5, 2008 the noncompliance process will no longer require the case manager or homeless coordinator, the shelter or the HAP provider to send a referral to support agencies before an incident can be submitted to the Noncompliance Committee.

This memo notifies staff that the TES-WN-13 (Attachment A) and the NFLST (Attachment B) are being revised to include a separate section to identify the name of the EA AU member(s) involved, a description of the incident(s)/violation(s) and the date(s) of each of the incident(s)/violation(s) occurred.

This memo clarifies the notification procedure to EA AUs on decisions by the Noncompliance Committee, summarizes and elaborates Field Operations Memo 2006-50, clarifies the noncompliance referral documentation requirements, distributes recently revised EA Notices (TES-WN-13, NFL-ST and NFL-9), and provides termination information for the TES-WN-13, NFL-ST and NFL-9.

Friday, April 27, 2007, will be the last date the Noncompliance Committee will be responsible for completing and mailing the appropriate notice to the EA family. Instead, the AU Manager/Homeless Coordinator will be responsible for completing and mailing the TES-WN-13 and the NFL-ST notice to the EA family.

EA notices have been updated to include local case worker phone number. This FOM also directs local offices to provide EA families with all of the documentation regarding the reason for adverse action if the family requests such information, and lists the documents that must be provided. 

In June 2007, the Commissioner sent a letter to all shelter providers and TAO Directors informing them that the Department was planning to review current EA regulations and procedures as they relate to homeless sheltered families, specifically around the noncompliance process. On October 9, 2007 a letter of clarification relative to the noncompliance process was issued to all shelter and HAP providers. This memo discusses the same issues contained in the October letter. THIS FOM IS OBSOLETE AND REPLACED BY FIELD OP MEMO 2008-62.

The process for referrals for determination of Emergency Assistance shelter noncompliance is being amended. Field Operations Memo 2007-64, which advised staff of the availability of support services provided through referrals to F.O.R. Families, Project RISE and Families Living Together, is now obsolete.
