| Field Op 2002-16 Waiving In-Office Face-to-Face Interviews for NPA FS AUs In an ongoing effort to expand access to food stamp benefits, USDA has clarified that more waivers of the in-office face-to-face interview should be given to applicants and recipients. An in-office face-to-face interview is an interview conducted at a TAO. AU Managers must inform applicants and recipients of their right to request a waiver of the in-office face-to-face interview. Applicants and recipients who have a hardship reason automatically qualify for a waiver of the in-office face-to-face interview below for the definition of hardship). AU Managers are encouraged to waive in-office face-to-face interviews whenever possible. Thus, all NPA FS AUs must be reviewed during the (re)application or recertification process to determine if a waiver of the in-office face-to-face interview is appropriate. | 7/15/2002 | ||

| Field Op Memo 2006-08: DTA Recertification of Bay State CAP AUs Recertification of Bay State CAP Assistance Units (AUs) will occur either when the Social Security Administration (SSA) redetermines eligibility for Supplemental Security Income (SSI) or when the Department of Transitional Assistance (DTA) recertifies the AUs. It is expected that the majority of Bay State CAP AUs will be recertified for food assistance benefits as part of the SSI redetermination. However, some Bay State CAP AUs will not be redetermined for SSI within the three-year certification period for food assistance benefits. FS households that complete a full Virtual Gateway application through either a health care or community provider, or who apply directly through the public Gateway access in the Fall River area will be allowed to "sign" the application electronically after they have filled it out and read the statemetn of their rights, responsibilityties and penalty/warnings. Appellant's son, her representative, said that he had tried to reach the case worker without success; voice mail messages were left and, on occasion, messages could not be left as the mailbox was full. Appellant was asked to submit 4 most recent pay stubs and inadvertently omitted one. Appellant didn't realize the mistake until she was sent a denial notice. She then called worker and faxed missing information, but was told that she needed to reapply. Hearing Officer found that Department should have sent a Notice of Pending, pursuant to 106 CMR 361.930 with specific information of what was needed to process her information. As missing information was submitted within 60 days of the initial application, the denial was incorrect and the hearing officer rescinded the denial and ordered eligibility determined retroactive to the initial date of application. | 5/26/2005 | ||
| Food Stamps -- Recertification -- Work Registration -- Notice Issues Food Stamps certification period ended 10/6/2004. Documents submitted to Department on 10/22/2005, and Department treated this as new application date. Application denied on 11/22/04 for failure to comply with work registration. Hearing officer found appellants testimony that she had not received an Augsut notice re need to recertify not credible, because she received other Department and DOH correspondence at that address. Hearing Officer found that because she did not recertify prior to expiration of her certification period, the stoppage of benefits on 10/06/04 was proper, and the submission of information on 10/22/2005 was properly treated as an application for inital certification pursuant to 106 CMR 366.340 (NOTE: Fed reg 7 CFR 273.14(e)(3) provides that since it was within 30 days of the end of the intial certification period, it should have been treated as a recertification) Hearing officer found that because appellant was now working, the denial on the basis of work regstration was improper; even though Department said that now appellant was ineligible due to income, Hearing Officer ordered the Department to evaluate the appellant's eligiblity from 10/222/04 forward. | 3/3/2005 | ||

She didn't receive the food stamp renewal application due to problems with her mail. If the resulting Food Stamp benefit is less than or equal to what the recipient already receives, BEACON will continue to pay the current level of benefits and leave the household as TBA.
